Terms of Service
These terms apply when you use the Phuse app and phuse.app (together, the “Service”), run by Phuse (“Phuse”, “we”, “us”). By creating an account or using the Service you agree to them. Please also read our Privacy Policy.
1. What Phuse is
Phuse is a platform where event organisers, activity providers, restaurants, attractions and other businesses (“Businesses”) list experiences, and where you can discover them, buy tickets and passes, make reservations and place orders. The Business that offers an experience is responsible for it: running the event, honouring your ticket, preparing your order, and its own policies. Phuse is not the organiser or provider of experiences listed by Businesses.
2. Your account
- You must be at least 13 to use the Service. If you are under 18, you need a parent’s or guardian’s permission to make purchases, and some experiences have their own age limits.
- Give accurate information and keep it up to date.
- You are responsible for activity on your account. Keep access to your sign-in email secure and tell us if you think someone else is using your account.
- You can browse without an account, but you need one to buy, book or order.
3. Tickets and passes
- A ticket or pass is valid for the experience and date it was bought for, and only once it has been paid for.
- Entry is subject to the Business’s rules, such as age limits, dress codes and security checks. A Business may refuse entry for reasons it reasonably decides.
- You may transfer a ticket to another person through the app where the Business allows it. Some tickets, including tickets that have already been scanned, can’t be transferred.
- Tickets obtained or resold outside the Service, or copied, may be cancelled without a refund.
4. Food orders and reservations
- Restaurants set their own menus, prices, taxes and any service charge, and decide whether you pay before your order is prepared or when you collect it.
- An order is confirmed when the restaurant accepts it. Each restaurant decides whether, and for how long, you can cancel.
- Reservations are subject to the restaurant’s availability and confirmation. Please arrive on time and cancel in the app if you can’t make it.
- Tell the restaurant about allergies or dietary needs directly. Menu information comes from the restaurant, and Phuse can’t guarantee it is complete or accurate.
5. Prices, fees and payment
- Prices are set by Businesses and shown in the local currency of the experience. Any amount shown in another currency is set by the Business and is for reference.
- A service fee may apply. Any fee is shown before you pay.
- Payments are handled by our payment processor. Phuse collects payments on behalf of Businesses.
6. Cancellations and refunds
Refunds are governed by the Business’s policy shown at the time of purchase. If an event is cancelled or significantly changed, the organiser is responsible for any refund, and we will help where we can. Service fees may not be refundable, except where the law requires it. For help with a purchase, contact the Business or email support@phuse.app.
7. Your content
You keep ownership of the reviews, photos, messages and other content you post. You give Phuse a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and share that content to operate and promote the Service. This licence ends when you delete the content, except where others have already shared it or we must keep it by law.
Reviews must be honest and based on your own experience. Anyone can report content, and we may hide or remove content, or suspend accounts, that break these terms. Content that receives several reports may be hidden while we review it.
8. Things you must not do
- Break the law, or post content that is unlawful, hateful, harassing, sexually explicit, violent or misleading.
- Impersonate anyone, or post content you don’t have the right to share.
- Buy tickets in order to resell them outside the Service, or use bots or automated means to access the Service.
- Interfere with the Service, try to get around its security, or access accounts or data that aren’t yours.
- Use the Service to send spam or unsolicited promotions.
9. Businesses
If you list experiences on Phuse, you are responsible for the accuracy of your listings, menus and prices, for complying with the laws that apply to your business (including licences, taxes and food safety), and for honouring the tickets, bookings and orders you accept. Paid features, payouts and fees may be covered by additional business terms.
10. Phuse’s rights
The Service, including its software, design and the Phuse name and logo, belongs to Phuse and is protected by law. We give you a personal, non-transferable right to use the Service in line with these terms.
11. Disclaimers
The Service is provided “as is” and “as available”. We work to keep it running and accurate, but we don’t promise that it will always be available or error-free, or that information provided by Businesses or other users is accurate. Nothing in these terms limits rights you have under consumer protection laws that can’t be excluded.
12. Limitation of liability
To the extent the law allows, Phuse is not liable for indirect or consequential losses, or for the acts or omissions of Businesses or other users, and our total liability to you for any claim relating to the Service is limited to the amount you paid through the Service in the 12 months before the claim, less amounts passed on to Businesses.
13. Ending your use of Phuse
You can stop using the Service and delete your account at any time in the app. We may suspend or close accounts that break these terms or put other users at risk. Tickets for future dates may be lost when an account is deleted, so transfer or use them first.
14. Governing law
These terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute, unless the law of the country you live in gives you the right to bring a claim there.
15. Changes to these terms
We may update these terms. We’ll change the date at the top, and if the changes are significant we’ll let you know in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.
